Conditions
This agreement defines the terms and conditions for NNYONLINE
Inc. (NNYONLINE)
to provide to the undersigned, the services requested on the NNYONLINE
Internet Registration Form, commonly known as Internet services.
I understand that NNYONLINE
may change its prices from time to time, and that I will be provided
fifteen (15) days notice of any such changes.
I understand that I will be billed in advance
for service. I will be billed for my first partial months service
and first two (2) full months service, in my first bill. I
understand that invoices are issued the first of the month and
payment will be due the 20th of the month. I understand that service
will be terminated the last business day of the month for
non-payment, and I will be billed a $15 re-activation fee if I wish
to reactivate.
I understand that this agreement is in effect
upon my signing and is automatically renewed each month. I
understand that I may cancel my service at anytime by contacting NNYONLINE’s
customer service at least fifteen (15) days before the end of the
month and that my service will be terminated no later than two
business days after the termination was requested and that I will be
responsible to pay the amount outstanding at the time of
cancellation.
As a subscriber to a Dialup Access Account, I
agree that my Dialup Access Account is a personal account, to be
used only by me. I agree to maintain my password as private and
confidential information. I agree to have only one instance of my
account logged on at any one time.
If I am subscribing to Web Server service, I
understand that my Homepage / Web page is located on NNYONLINE
property and use of NNYONLINE’s
bandwidth is a convenience to me. I will abide by NNYONLINE’s
judgment on appropriate content, links to other sites, and activity
concerning my Homepage / Web page while it is on NNYONLINE’s
computer and/or under NNYONLINE’s
maintenance and/or use of NNYONLINE’s
connection to the Internet.
If I am subscribing to Personal / Non-Profit
Homepage service, I agree not to use my homepage for commercial use.
I understand that if I use the homepage for commercial use or sale
of items or services, I will be billed for a commercial homepage.
I agree to use my account in a way that conforms to all applicable
laws and regulations. I specifically agree not to make any attempt
to gain unauthorized access to any system or network.
I understand that NNYONLINE
access numbers may be a toll call, and that NNYONLINE
is not responsible for any charges incurred accessing NNYONLINE’s
Internet service. I understand that NNYONLINE
maintains a reasonable but limited number of modems. I understand
that I may from time to time receive a busy signal when trying to
access my account. I understand that from time to time, NNYONLINE
will perform scheduled maintenance on the system that may interrupt
my ability to connect during that period of maintenance. NNYONLINE
will announce scheduled maintenance when possible and perform
unscheduled maintenance when circumstances require it.
I understand that the information available through NNYONLINE
or interconnecting networks may not be accurate. I understand that
some of the information available through NNYONLINE
or interconnecting networks may be intended for adult audiences. I
understand that internetworking communications are not secure, and
may be subject to interception or loss. NNYONLINE
makes no warranties of any kind, implied, or statutory concerning
the data or information available through the NNYONLINE
network, except clearly expressed warranties of security. I
understand that the use of my NNYONLINE
account, and any data or information accessed using that account,
will be completely at my own risk. I understand that the cumulative
liability of NNYONLINE
for any and all claims relating to the services provided by NNYONLINE,
in contract, tort, or otherwise, shall not exceed the total amount
of the basic service fees paid to NNYONLINE
for services within the prior year. I agree that NNYONLINE
shall have no liability for the services, data or information made
available to me, including any liability for any consequential,
indirect, special or incidental damages regardless of the success or
effectiveness of other remedies.
I understand that NNYONLINE
reserves the right to terminate my account at any time, for any
reason, including, but not limited to, my failure to abide by the
terms of this agreement or my failure to pay any fees or charges
when due. I understand that violation of certain generally accepted
guidelines on Internet usage, such as restrictions on mass mailings
and mass advertising, may cause severe difficulties for NNYONLINE
and would be a
likely cause for the termination of my account.
This agreement represents the complete
agreement between NNYONLINE
and me and supersedes any other written or oral agreement. The terms
of this agreement may only be changed in writing and both NNYONLINE
and I must sign any changes. |
